Terms & Conditions
OBJECT
This document constitutes a contract of adhesion for the use of the website www.carpinteriamexico.com ("Website") that is entered into by Lagofondo S.A. of C.V. (“Lagofondo” and/or “the Company”), as responsible and on the other hand, the User, subjecting both parties to the provisions of this document.
ACCEPTANCE OF THE TERMS AND CONDITIONS
By accessing or using this Website, the User is obliged to comply with and abide by the Terms and Conditions described herein and expressly declares their acceptance using electronic means for this purpose, in terms of the provisions of article 1803 and other relatives of the mexican Código Civil Federal.
If the Terms and Conditions of this contract are not fully accepted, the User must refrain from accessing, using and observing the Website and/or any other service offered by Lagofondo.
Lagofondo reserves the right to make any changes to the Terms and Conditions, Privacy Notice and any other provision established by Lagofondo on the website at any time. The only use of the website by the User once the change has been published, constitutes an acceptance of said change.
Lagofondo does not keep any individualized copy of this agreement between the User and the Company, therefore, it is the User's responsibility to keep a copy of these Terms and Conditions for their own file.
If the User violates what is expressed in these Terms and Conditions, Lagofondo may cancel any current agreement, as well as exclude the User from future operations, and/or take the legal action it deems appropriate for the User's interests.
USE OF THE WEBSITE WWW.CARPINTERIAMEXICO.COM
Lagofondo grants a non-transferable and revocable license to use the Website, under the terms and conditions described, for the purpose of purchasing personal items sold on the same Website. The User may only print and/or copy any information and/or image contained or published on the website www.carpinteriamexico.com exclusively for personal use, the commercial use of said information being prohibited.
The printing, publication, distribution, assignment, sale, reproduction by any means, partial or total, of any information, image, document or graphic that appears on the Website www.carpinteriamexico.com is prohibited for any use other than personal, at least that it has the prior written authorization of Lagofondo.
It is forbidden for the User to use the Website or its content within it to:
a)Any illegal purpose.
b)Solicit others to perform or participate in any unlawful act.
c)Violate any local, state, federal or international regulation, law or ordinance.
d)Violate Lagofondo's intellectual property rights or the intellectual property rights of any other natural or legal person within Lagofondo's Website.
e)Present false or misleading information.
f)Upload or transmit viruses or any other type of malicious code that can be used to affect the operation of the Website.
g)Track or collect personal information of others.
h)Make use of the Website for any obscene or immoral purpose.
INTELLECTUAL AND INDUSTRIAL PROPERTY AND COPYRIGHT
Lagofondo acknowledges that it is the sole owner of the intellectual and industrial property rights, whether registered or unregistered, on the Website www.carpinteriamexico.com, including but not limited to: projects, software, source code, graphics, photographs, videos, images, music, sounds, texts, logos, trademarks, domain names, trade names and data included in the Website. The entire content of our Website is also copyrighted as a collective work under Mexican copyright laws and international conventions. All rights reserved.
ORDER ACKNOWLEDGMENT
Quotations are valid for a period of 30 days unless otherwise stated. Following the buyer’s purchase order by fax, email or mail, a Lagofondo do Confirmation of Order constitutes a contract to supply as per our general Terms & Conditions. Any discrepancies must be notified within 3 working days of the receipt of order. Any typographical, clerical or other accidental errors or omissions on documentation or information issued by Lagofondo shall be subject to correction without liability on the part of Lagofondo.
CANCELLATION OF ORDERS
Cancellation of orders can only be accepted in writing. Cancellations will be accepted within 5 working days of receipt of the order. After this date, any cancellations may incur a cancellation fee of expenses incurred by Lagofondo as a result of the cancellation. In case of cancellations of non-standard finishes or volume orders, any deposits will not be refunded. Lagofondo reserve the right to cancel the order in the event that:
a) the buyer has breached one or more of these general Terms & Conditions.
b) the buyer has been subjected to any insolvency procedure.
c) the buyer delays payment.
PAYMENTS
All orders placed with Lagofondo are subject to payment terms as stated on Confirmation of Order and Invoice. All goods delivered remain the property of Lagofondo until the buyer has paid the price in full and no other sums whatever shall be due from the buyer to the seller.
Lagofondo will execute their statutory right to charge interest to late-payin clients.
PRICING
Lagofondo reserves the right to carry out price modifications when necessary without prior notice. If during the execution of an order any events arise such as to make impossible the execution of that order according to the fixed provisions or such as to cause a relevant increase of the prime costs, Lagofondo will be entitled to terminate the agreement. Lagofondo reserves the right to modify the prices fixed in the Price List in compliance with the current market situation and in the event that the order is not in conformity with the general offer of Lagofondo.
MODIFICATIONS AND DIMENSIONS
Whilst every effort is made to ensure accurate representation of product colors, finishes and dimensions, Lagofondo reserves the right to alter these details without notice in compliance with its own production needs,technological changes or in response to the current market situation.
CARE OF FINISHES
Every effort is made to ensure colour matches, however Lagofondo cannot guarantee exact colour match for any product finishes, wood or fabric variances.
LEAD TIMES
Lead times, as shown on the price list, are estimated times only. Lead times for non-standard items and large quantity orders will be advised upon order confirmation.
DELIVERY
Shipping times are excluded from the price list. Lagofondo standard delivery terms are to an agreed address, kerb-side only, or to a warehouse location and do not include offloading or installation of the goods. It is the responsibility of the buyer to provide, at the delivery point, and at the buyers’ expense, adequate and appropriate equipment and manual labour. Whilst Lagofondo will do all within our power to meet delivery dates, we shall not be under liability whatsoever for delay in estimated delivery times or failure to deliver for any cause, or from any loss or damages that arise. Lagofondo will not be liable for any damages in the event that the buyer has not respected directions provided concerning the assembly of a product, or for any damages arising from misuse or lack of maintenance and care of the delivered Items.
Receipts of goods showing obvious damage to items or packaging must be recorded in writing on the accompanying shipment documentation. In the case that the client cannot check receipt of goods immediately the phrase “received with reserve” must be recorded on all accompanying shipment documentation.
RETURNS
Any returns by buyer must be agreed in advance by Lagofondo.
DAMAGES
Notification of damage to any goods received, must be made by the buyer within 5 days of delivery. Images of packaging and damages must be sent with a condition report form correctly filled out and receipt acknowledged as received by Lagofonfdo. Any returns of damaged items must be agreed in advance by Lagofondo and will not be accepted unless the goods are in their original packaging.
WARRANTY
Lagofondo offers a 12month warranty on all products providing such Items and relevant accessories will reveal to be defective or unusable because of attested defects of manufacture or assembling and/or the buyer has been compliant with the agreed terms of payment. Lagofondo will not accept or pay for any Invoice sent by third parties for the repairing of defective products.
APPLICABLE LAW
The agreements regulated by these Terms & Conditions shall be governed by the mexican law and the buyer agrees to submit to the non-exclusive jurisdiction of mexican courts.
